Welcome to PressLux. These Terms of Service (“Terms”) are a binding agreement between you and Generique, LLC, a Wyoming limited liability company doing business as PressLux (“PressLux,” “we,” “us,” or “our”), governing your access to and use of the PressLux website, dashboard, API, and related services (collectively, the “Service”). By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please read Sections 6 (AI-Generated Content), 7 (Journalist Research), 8 (Wire Distribution), 15 (Disclaimers), 16 (Limitation of Liability), and 18 (Governing Law & Disputes) carefully. They limit our liability and shift important responsibilities to you.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and “you” refers to both you individually and that entity.
The Service is offered globally, but you are responsible for ensuring your use of the Service complies with the laws of your jurisdiction. We may refuse service to anyone in any jurisdiction where the Service would violate applicable law.
2. Your Account
To use most of the Service, you create an account using a valid email address and password. You are responsible for keeping your credentials secure, for all activity that occurs under your account, and for promptly notifying us at support@presslux.com if you suspect unauthorized use.
You agree to provide accurate information when registering and to keep it current. Accounts are personal to you (or to your organization) and may not be shared. You may soft-delete your account from the dashboard at any time; permanent deletion follows the schedule described in our Privacy Policy.
3. Credits, Billing & Refunds
The Service operates on a pay-as-you-go credit system. You purchase credits in packs through Stripe (our payment processor) and consume them as you use AI-assisted features (drafting, optimizing, outlet research, journalist research, pitch email generation) and wire distribution.
Credits do not expire. Pricing for each pack and the credit cost of each action are displayed in the dashboard at the time of purchase or use. We may change pricing for new purchases at any time; pricing for already-purchased credits is not retroactively adjusted.
Credits consumed for a successful action are non-refundable. If an automated action fails because of a verifiable system error on our side (for example, a hung API call or a parse failure that prevents the AI from completing the action), the associated credits are automatically refunded to your account, usually within a few minutes. You are not entitled to a refund because the output of an AI action did not meet your expectations; further iterations are available at the published credit cost.
You may request a refund of unused credits within 30 days of purchase by contacting support@presslux.com. Refunds are issued at our discretion and are not guaranteed. Wire distribution charges that are successfully cancelled prior to release (per Section 8) are refunded automatically as credits.
All fees are stated in U.S. dollars and exclude any applicable taxes, which you are responsible for paying.
Billing statement descriptor.Charges from the Service may appear on your credit-card or bank statement as “Generique” (the legal entity operating PressLux), “Generique PressLux,” or a similar variant depending on your card issuer. If you do not recognize a charge, please contact us at support@presslux.com before disputing with your bank.
4. The PressLux Service
The Service helps you build and send press communications. It includes:
- A guided brief intake form that captures the inputs the AI uses to draft your release.
- AI-assisted press release drafting, revising, and optimization, with the option to upload an existing release instead.
- AI-assisted research that suggests outlets and journalists likely to cover your announcement and drafts a personalized pitch email for each.
- A pitch tracker for managing copy-and-send outreach (status, follow-up dates, reply tracking).
- Optional wire distribution to news networks via third-party wire providers.
The Service is a tool. PressLux is not a public relations agency, publicist, lawyer, or financial advisor, and nothing in the Service constitutes professional advice. We do not represent you in front of journalists or wire services; you remain the sender, author, and publisher of all communications you initiate through the Service.
5. Your Content and License to Us
You own your content.Everything you input into the Service — briefs, uploaded press releases, attachments, edits to AI drafts, notes, and the like (“Your Content”) — remains yours.
You grant PressLux a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Your Content solely to provide the Service to you (including sending Your Content to our AI provider and, where you initiate distribution, to the wire provider). This license ends when you delete the content or your account, except as we are required to retain data by law or for legitimate backup and dispute-resolution purposes.
You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions for Your Content, including the right to attribute quotes, cite third parties, use images and trademarks contained in attachments, and submit the release for distribution. You are solely responsible for the truth, accuracy, completeness, and legality of Your Content.
6. AI-Generated Content — Your Responsibility
Several features of the Service use large language models from third-party AI providers to generate draft press releases, optimize copy, suggest outlets, identify journalists, and draft pitch emails (collectively, “AI Output”).
AI Output may be inaccurate, incomplete, misleading, or fabricated. Large language models can produce plausible-sounding text that contains errors of fact, attribution, statistic, citation, regulatory characterization, or law. AI Output may invent quotes, mischaracterize your announcement, or include details that are wrong even if your input was correct.
You are solely responsible for reviewing and verifying all AI Output before approving, copying, sending, or distributing it. By approving a draft, copying a pitch, or submitting a release for wire distribution, you confirm that you have reviewed the content and accept responsibility for it. PressLux does not check, verify, or guarantee the accuracy of any AI Output.
This responsibility is heightened for releases involving regulated subject matter, including but not limited to: pharmaceutical, medical-device, or clinical-trial announcements; financial results, securities offerings, or guidance; legal claims or outcomes; safety or recall notices; and statements that may be regulated by government agencies. The Service displays a guardrail notice when you mark a brief as regulated, but the responsibility for regulatory accuracy is yours, not ours.
If you publish, send, or distribute AI Output that turns out to contain errors, defamatory statements, infringing material, false advertising, securities-law violations, or any other unlawful content, you are responsible for the consequences, including any third-party claims. See Section 17 (Indemnification).
7. Journalist Research — Your Responsibility
The Service surfaces suggested outlets and journalist contacts derived from AI-assisted research. We make a reasonable effort to surface relevant, current contacts, but:
- Suggested journalists may have changed beats, employers, or contact information since our research was performed.
- Email addresses, article citations, and biographical details may be inaccurate, out of date, or in some cases fabricated by the underlying AI.
- We do not endorse any journalist, do not have any relationship with the journalists surfaced, and cannot vouch for their willingness to receive your pitch.
You are responsible for verifying any journalist’s identity, role, email address, and recent work before sending a pitch. The Service shows the article URLs cited per journalist so you can sanity-check the match — please do.
You may use journalist contact information surfaced by the Service only to send non-bulk, personalized, individually-considered communications about your specific announcement. You agree not to: (a) export contact information for bulk mailing or resale; (b) add journalists to general marketing or sales lists; (c) send pitches that violate any applicable anti-spam law (including CAN-SPAM in the United States, CASL in Canada, the GDPR and ePrivacy Directive in the European Economic Area, and the UK Privacy and Electronic Communications Regulations); or (d) use the Service to harass, threaten, or impersonate any journalist or publication.
Email outreach you copy from the Service is sent from your own email client or account; PressLux does not send the email on your behalf. You are the sender for all legal purposes.
8. Wire Distribution — No Guarantee of Publication or Timing
Wire distribution is provided through third-party wire service providers (collectively, “Wire Providers”). When you submit a release for wire distribution, you authorize PressLux to forward Your Content, contact information, and selected add-ons to the relevant Wire Provider for publication on their syndication network.
PressLux makes no representation or warranty regarding:
- The exact time a release will appear on any wire network or downstream outlet, even if you schedule an embargo time. Wire Providers process submissions in a queue and may experience delays of minutes, hours, or longer.
- Whether any specific outlet, publication, search engine, AI answer service, or aggregator will pick up, index, or display your release. Pickup is a function of editorial discretion at each destination and is not controlled by PressLux or the Wire Provider.
- The number, identity, or quality of pickup links surfaced after distribution. Pickup reports are provided as-is from the Wire Provider.
- That a release will not be rejected, modified, or removed by a Wire Provider for editorial, factual, regulatory, or policy reasons. Wire Providers may reject content that violates their guidelines, including content they judge to be inaccurate, defamatory, misleading, infringing, or non-newsworthy.
We are not liable for missed news cycles, time-sensitive opportunities, embargo violations, delayed pickup, non-pickup, or any consequential loss arising from wire distribution timing or outcome. If you have a strict time requirement (for example, a financial disclosure deadline, an SEC filing, or a coordinated multi-channel launch), you should not rely solely on wire distribution through the Service.
Cancellations: you may cancel a scheduled wire submission from the dashboard at any time before it is released. Cancelled submissions receive an automatic credit refund. Once a submission has been released to the Wire Provider, it cannot be recalled, and credits used are non-refundable.
Premium add-ons (for example, AP News, USA Today, or other premium networks) carry separate pricing controlled by the Wire Provider. Prices shown in the dashboard at the time of submission are the prices charged; we update them regularly but make no representation that they are the lowest available.
9. Acceptable Use
You agree not to use the Service to:
- Draft, generate, or distribute content that is false, defamatory, infringing, obscene, harassing, threatening, hateful, or illegal.
- Make securities-related statements that violate applicable securities laws or stock exchange rules (including issuing material non-public information without proper disclosure).
- Make medical, pharmaceutical, clinical, or safety claims that are not supported by competent scientific evidence or required regulatory clearance.
- Impersonate any person, company, or organization.
- Send unsolicited bulk commercial email to journalists or anyone else through email drafts copied from the Service in violation of applicable anti-spam law.
- Scrape, mirror, reverse-engineer, or attempt to derive the underlying data, prompts, or models used by the Service.
- Probe, scan, or test the vulnerability of the Service or circumvent any rate limits.
- Use automated systems (other than our published API, if any) to access the Service.
- Resell the Service or any of its outputs without our written permission.
We may suspend or terminate your account, without refund, for any violation of this Section.
10. Third-Party Services
The Service integrates with third-party providers, including without limitation our AI provider, payment processor (Stripe), wire distribution provider, transactional email provider, object-storage provider, and analytics provider. Your use of the Service is also subject to those providers’ terms and privacy practices. We are not responsible for the actions, content, or availability of third-party services.
11. Service Availability and Changes
We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any particular time or location. We may modify, suspend, or discontinue the Service (or any feature) at any time, with or without notice. We will use reasonable efforts to give advance notice of material changes that adversely affect paying users.
12. Termination
You may stop using the Service at any time and may soft-delete your account from the dashboard. We may suspend or terminate your access for any reason, with or without notice, including for violation of these Terms or to comply with applicable law. Sections that by their nature should survive termination (including 3, 5, 6, 7, 8, 9, 15, 16, 17, 18, and 19) will survive.
Upon termination by us for cause, no refunds are due. Upon termination by you, any unused credits are forfeited unless you request a refund per Section 3.
13. Intellectual Property
The Service, including its software, design, brand assets, and underlying technology, is owned by PressLux and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the term of these Terms. All other rights are reserved.
14. Feedback
If you send us suggestions, comments, ideas, or other feedback, you grant us a perpetual, irrevocable, royalty-free license to use the feedback for any purpose without obligation to you.
15. Disclaimers
THE SERVICE AND ALL CONTENT, INCLUDING AI OUTPUT AND ANY JOURNALIST DATA, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PRESSLUX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
Without limiting the foregoing, PressLux makes no warranty that: (a) AI Output is accurate, complete, or non-infringing; (b) journalist contact information is accurate or current; (c) any release submitted for wire distribution will be published, picked up, or seen by any audience; (d) any release will be distributed on a particular schedule; or (e) any specific business, marketing, or PR outcome will result from your use of the Service.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PRESSLUX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, REPUTATION, BUSINESS OPPORTUNITY, OR MEDIA COVERAGE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL PRESSLUX’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO PRESSLUX FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless PressLux and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to: (a) your use of the Service; (b) Your Content, including any release you draft, approve, copy, send, or distribute through or using the Service; (c) your violation of these Terms or applicable law (including anti-spam, securities, advertising, medical, or intellectual-property law); (d) AI Output that you publish, send, or distribute, including any defamation, infringement, false advertising, or regulatory violation claim arising from it; or (e) your communications with any journalist, publication, or wire provider.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Sheridan County, Wyoming (Sheridan) (proceedings may be conducted by video where the rules permit). Judgment on the award may be entered in any court of competent jurisdiction.
You and PressLux each waive the right to a jury trial and the right to bring or participate in any class, collective, or representative action. Notwithstanding the foregoing, either party may bring an individual action in small-claims court, and either party may seek injunctive relief in court for intellectual-property infringement.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the email associated with your account or by posting a notice in the dashboard at least seven (7) days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
20. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PressLux regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be given by email or by posting in the dashboard.
